Terms of the Cuddle Club Rewards Program

BE ADVISED that the terms and conditions of the Cuddle Club Rewards Program have been modified in order to introduce three (3) membership levels (each coming with new benefits and rewards).

BE ADVISED that any Member can refuse such modifications and terminate their participation in the Cuddle Club Rewards Program without having to pay any fees, indemnities, or penalties, by providing J.E. Mondou Ltd. with a written notice to that effect within the thirty (30) days that will follow the date on which the modifications will become effective. By continuing to participate in the Cuddle Club Rewards Program beyond the thirty (30)-day period, a Member will be deemed to have accepted the modifications discussed herein.

Description of the Cuddle Club

  1. Through its Cuddle Club Rewards Program, J.E. Mondou Ltd. (hereinafter, « Mondou ») allows eligible Members (who comply with the definition provided below) i) to earn trading units for each dollar spent in a Mondou store or the www.mondou.com website (hereinafter, « Cuddle Points »), and ii) to benefit from rewards and other incentives (such as the ones described herein). In practice, Cuddle Points can, free of charge, be exchanged for products and services available in stores and/or on the www.mondou.com website.
  2. By joining the Cuddle Club, the Member agrees to abide by (and comply with) the terms and conditions defined herein (hereinafter, the « Terms »). Any individual who does not accept all such Terms without exception should refrain from applying for membership to the Cuddle Club Rewards Program.

Eligibility requirements

  1. As membership to the Cuddle Club Rewards Program is free, no initial purchase is required in order to become a member.
  2. Each and every Member of the Cuddle Club (hereinafter, a « Member ») must:
    • Be a natural person of at least 16 years of age, who legally resides in Canada at the time of enrollment;
    • Join the Cuddle Club Rewards Program
    • Accept these Terms;
    • Provide a valid e-mail address. (« Member »)

Mondou may request photo identification (such as a driver’s license or a health insurance card) in order to confirm the eligibility of a prospective Member of the Cuddle Club. No Member can hold more than one (1) account at a time.

How to join the Cuddle Club

  1. You may join the Cuddle Club in any one of two ways:

Online

Any eligible Member can join the Cuddle Club by creating an online account on Mondou’s website (www.mondou.com). Simply select the My Account menu, and then click on Create Account and accepting these Terms. Once an online account is created, the eligible Member will have to reach the Cuddle Club menu and click on Become a Member. They will be asked to confirm the e-mail address provided at the time they applied for initial membership, by responding to a validation e-mail sent by Mondou. Once completed, an exclusive membership card number will then be assigned to the Member, who will be allowed to use it whenever purchasing products or services in a Mondou store or on Mondou’s website (www.mondou.com). No physical membership card will ever be issued.

In-store

A prospective Member may also obtain a Cuddle Club card from any Mondou store – in which case they will be asked to confirm the e-mail address provided at the time they applied for initial membership, by responding to a validation e-mail sent by Mondou. The card, which will be activated on the spot and will bear an exclusive ID number, may be used whenever the Member purchases products or services in a Mondou store or on Mondou’s website (www.mondou.com). In order to activate their online account, the Member must log on to the website, select the My Account menu, click on Create Account, and select a password.

Updating your personal information

  1. The Mondou Reward Program respects the Privacy Policy.
  2. The Member must make sure that the personal information they provide in support of their membership to the Mondou Reward Program remains current and up-to-date. In fact, Groupe Legault, its subsidiaries, parent companies, related, associated, connected and affiliated companies must, at all times, be able to rely on the personal information provided by the Member or any other individual appointed by the latter.
  3. The Member (or any individual appointed by the latter) can make changes to the personal information by logging on to the Member’s online account. They may also ask a cashier (working in any Mondou store) to modify personal information associated with a Cuddle Club account – being understood and agreed that said cashier, before proceeding with any changes, will have the right to validate the Member’s identity by means of photo identification.

Cuddle Club card

Overview

  1. The Cuddle Club card is in no way or manner a credit card.
  2. The Cuddle Club card shall remain Mondou’s sole and absolute property at all times.
  3. No Cuddle Club card may ever be duplicated or otherwise reproduced without Mondou’s explicit written consent.
  4. Any and all uses of a Cuddle Club card must comply with Mondou’s fundamental values.
  5. In the event where a Member was in possession of a card issued in connection with Mondou’s former Big Cuddle Club Rewards Program, no additional card will be necessary. The Member will keep their current card, whereas their exclusive ID number will thereafter be subject to the Terms applicable to the Cuddle Club (due consideration being given to their membership level).

Refusal

  1. Mondou may refuse to grant membership to the Cuddle Club Rewards Program to any prospective Member who :
    • Fails to comply with the membership procedures described herein; and/or
    • Provides inaccurate or incomplete information.
    • Does not comply with or accept the Terms of the Cuddle Club Rewards Program and Privacy Policy.

Lost or stolen account

  1. The Member whose Cuddle Club account was lost or stolen must forthwith notify Mondou’s customer service of the situation, by filling out the Contact Us form available on our website.
  2. All Cuddle Points accrued on the lost or stolen account will be transferred to the new account created and activated by Mondou, whereas the previous account will be automatically cancelled and a new membership card number will be issued to the Member. It is hereby understood and agreed that Mondou shall in no circumstances whatsoever be held liable for any transaction involving the Member’s account between the moment said account was lost or stolen and the moment Mondou was informed of the loss or theft.

Membership levels / monthly review

  1. The Cuddle Club Rewards Program revolves around three (3) levels of membership: Loyal, Devoted and Beloved. As explained in more detail below, a Member’s level will depend on the amount they spend in Mondou stores and/or on Mondou’s website (www.mondou.com).

Level Loyal

  1. Each new Member enters the Cuddle Club Rewards Program at Level Loyal.
  2. Level Loyal is also assigned to Members of the Cuddle Club who do not spend at least 124,99$ throughout the six (6)-month interval that comes before the first (1st) day of each month (each such interval being referred to as a « Reference Period »).

Level Devoted

  1. Level Devoted is assigned to Members of the Cuddle Club who spend between 125,00$ and 349.99$ throughout a Reference Period.

Level Beloved

  1. Level Beloved is assigned to Members of the Cuddle Club who spend at least 350,00$ throughout a Reference Period.

Monthly review of levels

  1. A Member’s level will remain current throughout the month at the beginning of which it was assigned. It shall then be reviewed on the first day of every month.
  2. Given such monthly review, the Member’s level will automatically be updated in order to reflect the amount they spent throughout the previous Reference Period.

Accumulation and redemption of cuddle points

Overview

  1. The Member will be able to earn Cuddle Points in any of two ways:
    • In store : by presenting their Cuddle Club card or providing their exclusive ID number, e-mail address, or phone number to the cashier at the time of purchase. The cashier may ask the Member to provide photo identification and/or to confirm the whole name of the Member whose account is being used.
    • Online : by being logged on to their Cuddle Club account (accessible through www.mondou.com) at the time of purchase.
  2. No Cuddle Points will ever be awarded retroactively (i.e., once a transaction has been finalized in store or online).

Allocation of Cuddle Points

  1. Subject to the provisions that follow, Cuddle Points will accrue to the Member’s Cuddle Club account as follows :

  1. Some products and services, as they do not allow the Member to earn Cuddle Points, are excluded from the calculation of the amount spent. Mondou may, without notice and at its sole and absolute discretion, add and withdraw products and services associated with the award of Cuddle Points.
  2. Mondou may, in the context of special promotional activities, award additional Cuddle Points upon purchase of specific products and services – in which case the Member shall only order the reasonable quantities they need il order to fulfill household purposes.
  3. No Cuddle points will be awarded should Mondou ever suspect that the products or services purchased are reserved for commercial purposes (such as resale).
  4. Both the number of Cuddle Points awarded in consideration for the transaction and the Member’s year-to-day cumulative will be displayed on the receipt. In the event where the Cuddle Points associated with the transaction did not show on the receipt on account of a technical glitch, they shall be added to the receipt issued with respect to the next transaction.
  5. Unless the Member submits convincing evidence to the contrary, the total amount of Cuddle Points displayed on a receipt will be deemed to be accurate.
  6. Mondou shall, at the time any product is returned and refunded, subtract the Cuddle Points awarded at the time said product was purchased. All refunds are governed by Mondou’s  Return Policy.
  7. No Cuddle Points will be awarded upon purchase or payment of the following items:
    • Fees associated with the delivery of orders placed online (www.mondou.com);
    • Gift cards;
    • Donations and sponsorships;
    • Medals engraved in-store.

Cuddle Points will, however, be awarded whenever a Member uses a gift card to make purchases.

  1. Mondou may, without notice and at its sole and absolute discretion, withdraw Cuddle Points from the account of a Member who:
    • Misuses their privileges (i.e., obtains points fraudulently, makes purchases reserved for resale or other commercial purposes, purchases more discounted products than they need in order to fulfill household purposes, etc.);
    • Is awarded Cuddle Points by mistake;
    • Refuses to abide by (and comply with) these Terms; and/or
    • Makes a false statement (including by providing inaccurate personal information).
  2. Cuddle Points have no cash value outside of the Cuddle Club.
  3. As Cuddle Points belong to the Member and no one else, they cannot be sold, assigned, transferred, allocated, exchanged, bequeathed, or gifted in any way other than those stipulated herein.

Redemption of Cuddle Points

  1. Cuddle Points, just like cash, can be used as a payment method at the time products or services are purchased in stores or online. They cannot, however, be exchanged for cash.
  2. Fifty (50) Cuddle Points shall correspond to a one dollar (1$) discount, regardless of membership level. There is no minimum amount required to redeem Cuddle points before the start of the purchase transaction.
  3. Only Members of the Cuddle Club can redeem Cuddle Points in any of these two ways:
    • In store : by presenting their Cuddle Club card or providing their exclusive ID number, e-mail address, or phone number to the cashier at the time of purchase. The cashier may ask the Member to provide photo identification and/or to confirm the whole name of the Member whose account is being used.
    • Online : by logging on to their Cuddle Club account (accessible through www.mondou.com) at the time of purchase.
  4. Cuddle Points can only be redeemed if the Member’s account, before purchase is to be made, already contains the number of points required to obtain the desired discount.
  5. The number of Cuddle Points required to obtain the desired discount will be subtracted from the Member’s balance at the time of purchase.
  6. The Cuddle Points that have not been redeemed, just as the ones earned on account of the transaction, will remain in the Member’s account and be available at the time of any subsequent transaction.
  7. Mondou may set up additional or customized promotional offers reserved for Cuddle Club Members (tailored to the latter’s respective level or not), in the context of which Members may redeem Cuddle Points, convert Cuddle Points into donations offered to organizations selected by Mondou, enjoy specific benefits, or take advantage of other rebates. Such promotional offers may vary from one Mondou store to another, or may only be available in-store or online.
  8. Mondou may, without notice and at its sole and absolute discretion, impose a redemption limit upon any Member who:
    • Misuses their privileges (i.e., obtains points fraudulently, makes purchases reserved for resale or other commercial purposes, purchases more discounted products than they need in order to fulfill household purposes, etc.);
    • Is awarded Cuddle Points by mistake;
    • Refuses to abide by (and comply with) these Terms; and/or
    • Makes a false statement (including by providing inaccurate personal information).

  1. The Doggie-Wash and Nail-Trimming services are subject to the Terms and Conditions of Reservations published on Mondou’s website – by which the Member hereby agrees to be bound should they ever use either service.
  2. As previously mentioned, a member subscribed to our newsletter may be eligible to a gift on their pet's birthday. The eligible Member may only collect such gift once in a calendar year, in connection with the anniversary of a single pet, whose profile they have completed by accessing the Add a new companion menu of their online account. In the event where several companion profiles were completed, the birthday gift will only be provided with respect to the pet whose profile was completed first. Such a birthday gift cannot be exchanged for cash.

Modification, suspension, and termination of the program

  1. Mondou may, without notice and at its sole and absolute discretion, modify the following parameters of the Cuddle Club Rewards Program:
    • Eligibility requirements;
    • The manner in which points are earned, calculated, redeemed, and/or exchanged.
  2. Program terms and conditions are subject to change. If significant changes are made, a notice of update will be issued to members either :

Such a written notice shall specify the extent and effective date of the proposed modifications. Any Member may refuse said modifications and terminate their participation in the Cuddle Club free of charge (i.e., without having to pay any cancellation fees or penalties) by providing Mondou with a written notice to that effect within the thirty (30) days that will follow the implementation of modifications. By continuing to participate in the Cuddle Club Rewards Program beyond that thirty (30)-day period, a Member will be deemed to have accepted the modifications in question.

  1. Mondou may, at any given time and at its sole and absolute discretion, terminate any membership and even cancel its Cuddle Club.
    • on the www.mondou.com website;
    • in Mondou stores; or
    • through a written notice sent by regular or electronic mail.
  1. Mondou may, forthwith and without the need for a prior notice, terminate the membership of any Member who it believes has failed to abide by (and comply with) these Terms.
  2. Mondou may, without the need for a prior notice, suspend its Cuddle Club temporarily on account of any event or situation (such as a technical breakdown or a computer virus) over which it cannot exercise any reasonable level of control.
  3. In order to terminate its membership to the Cuddle Club, a Member must file a request with Mondou’s customer service by filling out the Contact Us form available on our website , making sure to include all the personal information associated with their account so Mondou can confirm their identity. The Member’s account will be deactivated within thirty (30) days of receipt of such request – which means that the Member will no longer receive any kind of communications related to the Cuddle Club, whereas their subscription to Mondou’s newsletter and customized offers will remain unchanged.
  4. Whenever a membership is terminated for any reason whatsoever, the Member’s physical card (assuming they were given one), exclusive ID card number, and Cuddle Club account are cancelled and any balance of points left in the account is expunged and brought down to zero.
  5. In accordance with the requirements of section 187.8 of the Consumer Protection Act and section 79.6.3 of the Regulation respecting the application of the Consumer Protection Act, Cuddle Points may expire on a preset date if the Member’s account remains inactive for more than a year – in which case:
    • A written notice of inactivity will be sent to the Member, informing them that their balance of Cuddle Points will expire at a specific date unless action is taken;
    • Such a notice of inactivity will be dispatched at least thirty (30) but no more than sixty (60) days before the Member’s Cuddle Points are set to expire.

Contests

  1. By joining the Cuddle Club Rewards Program, Members irrevocably (and without having to provide any further consent) agree to participate in any and all contests held by Mondou or any of its suppliers and whose terms and conditions include the use of a Cuddle Club account. Such an implied agreement does not impose on any Member the obligation to claimi any prize they might have won.
  2. No such automatic participation shall ever allow Mondou or any of its suppliers to collect from any Member any personal information other than the ones obtained at the time the Member joined the Cuddle Club. Mondou shall, in any event, ensure the privacy of the personal information provided by its Members, and only disclose such information to the contest organizer insofar as (i) the Member has consented to the disclosure in writing, and (ii) the information is instrumental to the Member’s participation in the contest.  

Privacy

  1. Mondou will ensure the privacy and security of the personal information it collects about Members, the whole in accordance with the Privacy Policy published on its website.

Newsletter, offers, and customized communications

  1. By joining the Cuddle Club, the Member agrees to receive the e-mail newsletter Mondou releases periodically.
  2. By joining the Cuddle Club, the Member also authorizes Mondou to send them advertising, promotional, and marketing materials in different ways, including:
    • direct contact with the Member through the phone, regular mail, and electronic mail;
    • advertisements (posted on www.mondou.com as well as on third-party websites and social networks) that Groupe Legault, its subsidiaries, parent companies, related, associated, connected and affiliated companies, believes could be of interest to the Member;
    • customization of the content the Member has access to on Mondou’s website (www.mondou.com), third-party websites, and social networks; and
    • targeted offers and recommendations pertaining to products and services.

Indemnification / limited liability

  1. The Member shall indemnify Mondou and hold it harmless against any and all third-party demands, claims, civil suits, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising from their membership to the Cuddle Club Rewards Program and/or the services and rewards they are provided with. In no circumstances whatsoever shall Moudou or its directors, agents, representatives, or employees ever be held liable for any kind of direct, indirect, collateral, special, consecutive, or punitive damages resulting from the Member’s participation in the Cuddle Club and/or its related services and rewards (including, without being limited to, damages caused by the modification or cancellation of a membership to the Cuddle Club rewards program).

Miscellaneous provisions

  1. All decisions Mondou takes in regards or with respect to the Cuddle Club are final, without appeal, and binding upon all Members.
  2. The interpretation and fulfillment of these Terms shall be governed by the laws and regulations in force within the province of Québec, as well as by the laws and regulations of the Parliament of Canada which are likely to apply.
  3. Should any discrepancy or contradiction ever arise between the English and French versions of these Terms, the latter shall prevail.
