Terms and Conditions – Mondou Breeders Club

  1. The Mondou Breeders Club (hereinafter the “Club”) is available in all Mondou stores, as well as on the Mondou website, with some restrictions. The use of your Club card in Mondou stores and on the Mondou website is governed by the Terms and Conditions of the Club contained herein. By participating in the Club, you agree to be bound by these Terms and Conditions, which are subject to changes without prior notice. If you do not accept all related Terms and Conditions, please refrain from participating in the Club.

Membership Enrolment

  1. Customer-Breeders must become members by following the steps described hereunder in order to benefit from the advantages of the Club (hereafter a “Member”). Membership is free and no initial purchase is required. Members of the Club must be 18 years of age or older and must reside legally in Canada. A future Member of the Club should duly complete the Online Club Membership Application Form available on the Mondou website at com/breeders. The future Member shall then be available to receive a scheduled visit of his/her breeding facilities by a Mondou representative in order to assess the eligibility criteria described hereunder in the Evaluation Checklist section. Further to visiting breeding facilities, Mondou shall issue a written decision regarding completion of the Evaluation Checklist. If the eligibility criteria are met, the Customer-Breeder should sign and return to eleveur@mondou.com the Club’s Commitment reproduced hereunder. A membership card is then activated and sent directly by mail to the Customer-Breeder along with other administrative documents and Mondou adoption booklets.
  2. Online Club Membership Application Form
    Customer-Breeders must complete the Online Club Membership Application Form and provide Mondou with personal information, which information are subject to Mondou’s Privacy Policy and information regarding breeding’s. To be admitted as a member of the Club, a Customer-Breeder must agree to the terms and conditions of the Club, which may be subject to changes from time to time without prior notice.

  3. Visit by a Mondou representative and Evaluation Checklist:
    After having completed the Online Club Membership Application Form, Customer-Breeder should be available to receive a scheduled visit by a Mondou representative in order to assess the following criteria:
  • The breeding stock is made up of at least two (2) breeding females, and at least one (1) litter of offspring is sold for adoption every year.
  • The establishment has enough staff to properly care for the animals and attend to their needs (approximately one (1) person for every fifteen (15) animals).
  • The animals appear to be healthy and well-maintained (claws, coat, eyes, ears, skin, stools/litter) or are being treated for any conditions they may have. The animals are not stressed.
  • All spaces to which the animals have access are daylit, well-ventilated, and temperature-controlled.
  • All spaces to which to which animals have access and all objects within those spaces:
    • Do not threaten their safety and are without risk of injury (building, outdoor space, cage, equipment, accessories).
    • Are clean, safe and in good condition (building, outdoor space, cage, equipment, accessories).
  • In the case of dogs breeding operations, all enclosures are of a reasonable size and the floor is dry and level:
    • Cage: Enabling the dogs to stand without touching the ceiling and lie down with limbs outstretched. (One adult aged dog per cage.)
    • Dog pen: Enabling the dogs to lie down with limbs outstretched. (One adult aged dog per pen.)
    • Dog Exercise Pen: Rectangular shape and allowing the movement of all dogs. (Two to four compatible dogs per enclosure.)
  • In the case of cats breeding operations, the size of the cat pen is of a size enabling them to move, hide, use litter and have access to drinking water. The pen must allow the cat to climb and use all the volume of the pen.
  • If the animals go outside, the areas they can access include a kennel, shelter or shaded area as well as an access to drinkable water.
  • A maternity area is provided for females nearing the end of their gestation period and those with offspring under 2 to 4 weeks of age. This area is quiet, isolated and suitable for giving birth.
  • In the case of dogs breeding operations, every dog is given time to exercise outdoors on a daily basis and of a sufficient duration depending on the type of accommodation.
  • In the case of cats breeding operations, every cat has access to exercise space.
  • Every animal is brought up in a favorable environment, always enjoy harmonious physical or visual contact with conspecifics and benefits from daily and positive contact with at least one human being. The animals are sensitized with the noises of the neighborhood, the household items and, ideally, different odors. The socialization between cats and dogs is strongly encouraged.
  • The tins are clean and seem well maintained, fresh water is available at all times. Every animal is provided with sufficient food.
  • A veterinarian handles all high-level esthetic and medical procedures. Every offspring is examined by a veterinarian before being adopted and every animal is examined by a veterinarian every eighteen (18) months or less.
  • The physical and psychological needs and capabilities of every animal are taken into consideration during breeding (Reproduction plan and retirement plan).
  • During breeding, the breeder shall take the necessary measures to avoid, eliminate or limit health problems in offspring.
  • Every animal sold for adoption:
    • Is sterilized according to the recommendation of the breeder and a proof of sterilization is issued.
    • Receives an identification microchip or tattoo.
    • Is sold only when the breeder is convinced that he will be treated as well in the future owner’s house as at home, for the entire life of the animal.
Everyone who adopts a pet receives a proof of purchase and proper after-sale service (sterilization, non-reproduction clause and relocation assistance).
    1. Improvement Period

    Within a reasonable delay after visiting the Customer-Breeder installation, Mondou will inform Customer-Breeder of its decision regarding membership to the Club.

    • If eligibility criteria are met, the Customer-Breeder must sign the Commitment to the Club reproduced hereunder.
    • If some of the criteria are not met, an improvement period should be granted in order for Customer-Breeder to remedy to the situation and duly meet all of the eligibility criteria. Photographic proof or a second visit by a Mondou representative will be required in order to establish completion of the criteria.
    • If the changes done by the Customer-Breeder during the improvement period still do not meet the eligibility criteria or if the improvement required after the first visit is too important, the Customer-Breeder shall obtain an Anima-Quebec certification in order to comply with the eligibility criteria and be admitted as a member of the Club.
    1. Commitment to the Club

    In order to maintain their Club membership and the associated benefits, Members agree and undertake to comply with the following conditions, failing which Mondou may, at its sole discretion, definitively and without notice, void the Membership and all Cuddle points earned.

    • Comply at all times with the Club membership criteria contained in the evaluation checklist available at mondou.com, specifically with respect to animal health and wellbeing, as well as site and equipment maintenance and safety, as demonstrated during the prerequisite Club registration visit.
    • Abide by all applicable municipal, provincial and federal laws governing breeding, including those regarding workplace health and safety, fire prevention and animal health and welfare.
    • Agree to receive scheduled visits by a Mondou representative.
    • Agree to provide, at the request of a Mondou representative, the contact details of clients who have adopted pets in the past twelve (12) months.
    • Submit a Mondou adoption booklet to every potential adoptive family when they reserve one of your animals for adoption.
    • Notify Mondou of any major changes (those that could affect the evaluation checklist) regarding the living conditions of the animals in your establishment.
    • Agree to be bound by the terms of the Club, which are available at mondou.com.
    • To not lend your Club card to anyone for any use not directly linked to your breeding operation; the benefits of Club membership are reserved exclusively for breeders who have earned this preferred status.
    • To not resale directly or indirectly products purchased from Mondou (in store or on line).
    1. Additional copies of the Mondou adoption booklet are available to order by email at eleveur@moudou.com, should additional copies be required. Members should mention the number of Mondou adoption booklet required when ordering. Any order of Mondou adoption booklet should be picked up by the Member at its favorite Mondou store nearby. The Mondou adoption booklets are provided to Members for free. In order to benefit from the advantages of the Club, the Member should provide for free a Mondou adoption booklet to every potential adoptive family of a pet upon reservation of one of the Member’s adoption pet.
    1. The Club card is not a credit card. It is the property of Mondou, and it may be revoked according to the conditions set forth in these Terms and Conditions.
    1. Members are provided with a Club card labelled with a unique number registered under their names. If Member is already a member of the Mondou Cuddle Club reward program, the Cuddle point accumulated as of the date of his/her membership to the Club will be transferred to the Club card and the Cuddle card previously issued will be immediately voided.
    1. Members of the Club must inform Mondou of any changes to their personal information (as hereinafter defined), namely their name, address, telephone number and e-mail address, in their online Mondou account located on the Mondou website, www.mondou.com. Members are responsible for ensuring that all information provided is up to date. Mondou may contact the Member in order to verify any information it believes may be incorrect. Mondou reserves the right to cancel any Club card with incomplete or inaccurate personal information, as well as to withhold all Cuddle points that have been accumulated on that Club card through the Club. The submission of false personal information will result in the forfeiture of all accumulated Cuddle points related to the concern account.
    1. Mondou reserves the right to refuse issuance of a Club card to any breeder who does not comply with established enrolment procedures.
    1. In order to collect Cuddle points and earn rewards, Club Members must present their own valid Club card in a Mondou store, or enter their Club card number on the Mondou website. Any unauthorized reproduction of the Club card may lead to legal prosecution and forfeiture of all accumulated Cuddle points and membership in the Club. However, Members may use mobile loyalty card management applications.
    1. Only natural persons may participate in the Club; namely corporations, partnerships, joint ventures, groups and associations are excluded. Cuddle points will not be awarded if Mondou believes that purchased products will be used for resale, or for other commercial purposes; Cuddle points accumulated through such purchases will be forfeited. Mondou reserves the right to limit the number of Cuddle points awarded through promotional offers or events to prior reasonable use regarding the type of breeding. If a Member of the Club purchases product quantities exceeding prior reasonable use regarding the type of breeding, awarded Cuddle points he or she accumulated through a promotional offer or event, the said Cuddle points may be forfeited without prior notice.
    1. Members are responsible for immediately reporting a lost or stolen Card, or unauthorized access to their account on the Mondou website. They must do so by contacting Mondou at the following address: eleveur@mondou.com. In order to receive a new Club card by mail, Members must provide their Club card number (if known), as well as their contact information (name, address and telephone number). Accumulated Cuddle points will be transferred to the new Club card once it is issued, and the previous Club card will be cancelled. Mondou is not liable for any account transactions that occur between a Club card’s loss or theft, or unauthorized account access, and when said loss, theft or unauthorized access is reported to Mondou.
    1. Mondou reserves the right, in its sole and absolute discretion, to request identification or proof of admissibility, including but not limited to a government-issued photo ID, for the purposes of verifying a Member’s Club eligibility and ensuring compliance with the Club’s Terms and Conditions. Failure to provide such identification to Mondou’s satisfaction may result in Club card cancellation.
    1. The Club is the property of J.E. Mondou Ltd. (‘‘Mondou’’), which can at any time refuse to issue a Club card to a customer who fails to comply with established registration procedures. In addition, in cases of reasonable doubt, Mondou may forfeit accumulated Cuddle points and rewards, as well as withdraw or cancel the Card of any Member who has submitted false information, abused of his or her privileges or has refused to comply with the Terms and Conditions governing the Club.

    Cuddle points Accumulation

    1. Each Member will receive a reward of five thousand (5,000) Cuddle points as welcome bonus and upon activation of the Club card.
    1. Following enrolment, Members may accumulate Cuddle points by presenting their valid Club card when purchasing products at Mondou stores, or by using their Club card number when purchasing on the Mondou website. Members must present their Club card to the store cashier before the end of the transaction. The actual Club card must be presented at all times; facsimiles or photocopies of the Club card will not be accepted. However, Club cards that are registered with a mobile loyalty card management application will be accepted. In addition, no Cuddle points will be awarded once the transaction is completed. The computer system does not award Cuddle points for previous purchases that were made without presentation of the Card. For online purchases via the Mondou website, members must be connected to their online Mondou account associated a Club card upon completion of a transaction.
    1. Cuddle points will be awarded at the rate of 7.5 Cuddle points per dollar spent on admissible purchases made in-store or online. Cuddle points are calculated on the total net amount (purchase price minus discounts), before taxes and transportation fees, shown on the transaction receipt. The total number of Cuddle points awarded and registered for the transaction receipt will be rounded down to the nearest dollar of the purchase amount.
    1. Cuddle points will be awarded at the rate of 12.5 Cuddle points per dollar spent on the brand Oven Baked dried or wet pet food purchased in-store or online. Cuddle points are calculated on the total net amount (purchase price minus discounts), before taxes and transportation fees, shown on the transaction receipt. The total number of Cuddle points awarded and registered on the transaction receipt will be rounded down to the nearest dollar of the purchase amount.
    1. Cuddle points will be awarded at the rate of 12.5 Cuddle points per dollar spent on the brands Blue Buffalo, Nutrience et Vetdiet dried or wet pet food purchased in-store or online. Cuddle points are calculated on the total net amount (purchase price minus discounts), before taxes and transportation fees, shown on the transaction receipt. The total number of Cuddle points awarded and registered on the transaction receipt will be rounded down to the nearest dollar of the purchase amount.
    1. In addition to the exclusive advantages of the Club, every Member shall benefit from the promotions offered to members a Mondou Cuddle Club reward program, except for the following offers:
      • Double the Cuddle points reward: The Members are not eligible to double the Cuddle points reward on brand Vetdiet and O’select. This promotion is offered exclusively to regular members of the Mondou Cuddle Club reward program, and is less advantageous for Members.
      • Bonus Cuddle points: During promotional offers, Mondou may offer bonified Cuddle points rewards for selected products. Mondou will determine which offer (Club advantages or Mondou Cuddle points reward program) is more advantageous for the Member and the Member will benefit from the best offer.
    1. No Cuddle points are attributed for purchasing the following brand: Fancy Feast, Friskies, Temptations, Whiskas as well as the following products and services: gift cards and prepaid cards, sponsorships and donations, medals engraved in-store and special orders. Notwithstanding the aforementioned, Cuddle points will be issued to gift card holders if the gift card is being used to pay for their purchases.
    1. In the event that Cuddle points are inadvertently awarded, Mondou reserves the right to revoke them at any time, without prior notice. Mondou also reserves the right to add or exclude eligible items from the Club or to modify the number of Cuddle point attributed by dollar spent for a type of product (including by brand), at its sole discretion, without prior notice.
    1. Upon presentation of the Card before the end of a transaction, all available Cuddle points appear on the receipt of said transaction. In the event that Cuddle points do not appear on the receipt due to technical difficulties, they will be updated on the following purchase receipt. Members of the Club may also inquire about their Cuddle points balance on the Mondou website.
    1. Product returns are handled according to Mondou’s Conditions of Sale. Upon the return of a product, Mondou will subtract the Cuddle points earned upon purchased for the returned product, or any promotion involving said product, from a Member’s account.
    1. In the opinion of, and at the sole discretion of Mondou, all point totals shown on transaction receipts will be deemed correct unless there is proof to the contrary. Mondou reserves the right to set limits on the exchange of Cuddle points, or to impose a temporary ban on said exchange.
    1. Cuddle points will be reset to zero upon cancellation of a Club membership.
    1. Upon the death of a Member, his or her account will be closed and all accumulated Cuddle points will be forfeited. Cuddle points are indivisible, namely in the case of divorce.
    1. Cuddle points and rewards have no monetary value and cannot be exchanged for money. Cuddle points have no value outside the Club and cannot be transferred, sold, attributed, ceded, exchanged, bequeathed or offered as a gift. Only Members can accumulate Cuddle points and exchange rewards upon presentation of their Card (or their Card number on the Mondou website).
    1. Should a Member’s card not be used in any purchases over a period of 12 consecutive months, the membership will be deemed inactive and all previously-accumulated Cuddle points will be forfeited. The Member’s Cuddle points balance will therefore be reset to zero.

    Cuddle points Exchange

    1. Cuddle points can only be used as exchange value on selected products and applied on the sale price after all applicable taxes in the Member’s favorite store or on Mondou website, as follows:

    1. The number of Cuddle points required to obtain the desired reward exchange value will be subtracted from the Member’s account balance of Cuddle points. Unredeemed Cuddle points, as well as Cuddle points accumulated during the pending transaction, will remain in the Member’s account and can be applied to a subsequent transaction.
    1. Cuddle points can only be redeemed if the number of Cuddle points required to obtain the desired reward exchange value are reached prior to the pending transaction.
    1. From time to time, Mondou may offer additional or exclusive promotions to Club Members, allowing said Members to exchange Cuddle points for items other than saving rewards, as well as enjoying several other advantages or discounts. Promotional offers may vary from store to store.

    Large Transaction

    1. In order to protect our environment, it is recommended that Members regroup their online purchases, if possible. Please refer to the Terms of Sales and FAQ available in the online store via the Mondou website for more details.
    1. Members should always inform in advance by phone an employee of Mondou at their favorite store nearby when ordering a large number of products to ensure that stock are sufficient and to avoid stock out. Members should then be able to place their order in store at the date indicated by Mondou employee.
    1. Mondou may at any time refuse to complete a transaction that may create any stock out either in store or online.

    Confidentiality

    1. Mondou guarantees the confidentiality and security of all personal Member information, in compliance with Mondou’s Privacy Policy available at the following address: https://www.mondou.com/politique-de-confidentialite.en.html.

    Club Termination and Adjustments

    1. Mondou reserves the right to restrict, interrupt, or in any other way modify any aspect of the Club at any time, including without limitation, the eligibility terms, the manner in which the Cuddle points are obtained, the method for calculating the rate at which the Cuddle points are obtained, the manner in which the Cuddle points are exchanged and the method for calculating the Cuddle points exchange rate. Members will be advised at least 30 days prior to any restriction, interruption or change made to the Club via the Mondou website and via an e-mail notice specifying the new or modified provision, accompanied by its former formulation, as well as the date the change shall be effective. Members may refuse this modification and terminate their participation in the Club without charge, penalty or termination indemnity. Members must advise Mondou to this effect within thirty (30) days of the effective date of the modification, if said modification requires an increase in the members obligation or the reduction in Mondou’s obligations. A Member’s continuing participation in the Club after such a notice is given constitutes their expressed consent.
    1. Mondou reserves the right to terminate the Club at any time, at its discretion, without being attributed any responsibilities or obligations. Members will be advised at least 60 days in advance, online and by way of a notice sent by e-mail.
    1. If a Member wishes to terminate or cancel his or her participation in the Club, he or she must send a request to: eleveur@mondou.com. In order for the cancellation to be processed, Members must include their contact information (name, address and telephone number) and Club card number. Please note that this email address is solely reserved for the termination of the Membership Club mentioned herein; and not for the cancellation of any other online membership found on the Mondou website (e.g.: the newsletter). The Club account will be closed 30 days following receipt of the request, and the Club card associated to the said account will no longer be valid.

    General Terms

    1. By enrolling in the Club, Members agree to receive information concerning their participation in the said Club.
    1. Any decisions made by Mondou concerning the Club are final and bind all members without the right of recourse.
    1. Mondou reserves the right to suspend the Club at any time, without prior notice, in the event of an error, omission, technical issue, computer virus, bug, falsification, unauthorized intervention, or any other cause outside Mondou’s reasonable control, which interferes with the proper functioning of the Club.
    1. Mondou has taken all the necessary measures to ensure the accuracy of the information contained herein. However, Mondou accepts no responsibility for any error or omission.

    These Terms and Conditions are governed by the laws of the province of Quebec and the federal laws of Canada applicable therein.
