Cuddle Club and Big Cuddle Club Terms and Conditions

DESCRIPTION OF THE CUDDLE CLUB AND BIG CLUB CLUB

  1. The Cuddle Club and Big Cuddle Club (collectively referred to as the “Cuddle Clubs”) rewards programs allow members to earn points in exchange for dollars spent at Mondou, either in store or online. Points can be exchanged free of charge for Mondou goods or services, in store or online.
  2. As a participating member of the Cuddle Clubs, you agree to the specified terms and conditions. If you do not agree to all the specified terms and conditions, please do not participate in the Cuddle Clubs.

ELIGIBILITY CRITERIA

  1. Cuddle Club membership is free, and no initial purchase is required.
  2. Cuddle Club members must:
  • Be a physical person aged 18 or over and reside legally in Canada at the time of registration
  • Provide a valid e-mail address

Mondou may require proof of identification with a photo, such as a driver’s license or a health insurance card, to verify a member’s eligibility to participate in the Cuddle Clubs.

HOW TO BECOME A CUDDLE CLUB MEMBER

  1. The following steps are required to become a Cuddle Club member:

Online

  1. Fill out the Cuddle Club registration form at mondou.com. Your registration will be complete and your electronic card available on the website will be activated.

MEMBERS WILL NOT RECEIVE A PHYSICAL CARD WHEN REGISTERING ONLINE.

In store

  1. Obtain a Cuddle Club card at a Mondou store
  2. Activate your card by filling out the Cuddle Club registration form either:
    • online at mondou.com
    • at a Mondou store, with a cashier

IT IS NOT POSSIBLE TO REGISTER DIRECTLY FOR THE BIG CUDDLE CLUB.

UPDATING PERSONAL INFORMATION

  1. Members are responsible for keeping any information related to their Cuddle Club membership up to date.

MEMBERSHIP CATEGORY

Cuddle Club and Big Cuddle Club

  1. Cuddle Clubs have two membership categories:
  • Cuddle Club member (basic level)
  • Big Cuddle Club member (VIP level)

The category to which a member belongs depends on the annual purchase volume, which is calculated from January 7 of a given year to January 6 of the following year (the “reference year”).

Annual purchase volume

The annual purchase volume is as follows:

  • Cuddle Club member: $0-$1,999.99
  • Big Cuddle Club member: $2,000 or more

MEMBER STATUS

Effective date of a member’s status

  1. A member’s status (either Cuddle Club or Big Cuddle Club) is determined and granted annually on February 1 of each year (the “effective date”) on the basis of the member’s annual purchase volume during the previous reference year. Members can consult their status at any time by accessing their online account.
  2. Achieving Big Cuddle Club status

Cuddle Club members who reach the required annual purchase volume during the previous reference year will be automatically upgraded to the Big Cuddle Club on the effective date.

  1. Losing Big Cuddle Club status

Big Cuddle Club members who fail to reach the annual purchase volume required during the previous reference year will automatically lose their Big Cuddle Club status on the effective date.

  1. Maintaining Big Cuddle Club status

Big Cuddle Club members who reach the required annual purchase volume during the previous reference year will automatically maintain their Big Cuddle Club status on the effective date.

CUDDLE CLUB AND BIG CUDDLE CLUB CARDS

General

  1. Cuddle Club and Big Cuddle Club cards are not credit cards, and remain the property of Mondou at all times.
  2. It is forbidden to reproduce these cards without Mondou’s prior written consent.
  3. These cards must be used in accordance with the values advocated by Mondou.

Physical or electronic card

  1. The type of Cuddle Club card that you have depends on the way in which you register:
  2. Online registration: members will not receive a physical card. Their electronic card available on their Mondou online account is the only card associated with their membership. Each member is assigned a specific member number.
  3. In-store registration, with online or in-store card activation: members immediately receive a Cuddle Club card, and are assigned a specific member number.

Card associated with a change in member status

  1. Achieving Big Cuddle Club status

If a member reaches the required annual purchase volume during the previous reference year:

  1. The member number will be associated with Big Cuddle Club advantages as of the effective date.
  2. If a physical Cuddle Club card was issued: the member will receive a Big Cuddle Club card by mail, at the address specified in the member account.
  3. If an electronic Cuddle Club card was issued: the member will receive an e-mail at the address specified in the member account, indicating the new status. No Big Cuddle Club card will be issued.
  4. Losing Big Cuddle Club status

If a member fails to reach the required annual purchase volume during the previous reference year:

  1. The member number will be associated with Cuddle Club advantages as of the effective date.
  2. If a physical Big Cuddle Club card was issued: no Cuddle Club card will be sent. The member will keep the Big Cuddle Club card, but will benefit only from Cuddle Club advantages.
  3. If an electronic Cuddle Club card was issued: the member will receive an e-mail at the address specified in the member account, indicating the loss of Big Cuddle Club status. No Cuddle Club card will be sent.

Refusal to issue a card or card cancellation

  1. Mondou reserves the right to refuse to issue a card to a member who:
  • Does not follow the established registration procedure
  • Provides inaccurate or incomplete information

Lost or stolen card

  1. In the event of a lost or stolen card, members must immediately e-mail Mondou at mondoucalin@mondou.com or call Mondou Customer Service at 1-855-411-5300.
  2. The points accumulated on the lost or stolen card will be transferred to the new card, and the old card will be automatically cancelled. A new member number will be issued. Mondou cannot be held responsible for transactions made to the account between the time when the card was lost or stolen and when Mondou was notified.

POINTS

Earning Cuddle Club or Big Cuddle Club points

  1. In order to earn Cuddle Club or Big Cuddle Club points, members must:
  • In store: show the cashier their electronic or physical card at the time of payment.
  • Online: access their Cuddle Club or Big Cuddle Club account on Mondou’s website at the time of payment.

NO POINTS CAN BE AWARDED ONCE THE TRANSACTION HAS BEEN COMPLETED.

Calculating members’ points

  1. Points will be awarded to members via their Cuddle Club or Big Cuddle Club cards as follows:

*Amount spent: total net amount rounded down to the nearest dollar (before tax) – including applicable discounts.

  1. Some products and services are not eligible for points and are therefore excluded from the calculation of the amount spent. Mondou may add or withdraw products for which members can earn points at its sole discretion and without prior notice.
  2. As part of special promotional offers, Mondou may offer additional points with the purchase of some products and services. Members must agree to limit their purchases to a quantity consistent with normal household use.
  3. No points will be awarded if Mondou suspects that the products and services are being purchased for the purpose of resale or commercial use.
  4. The accumulated points and total points associated with the most recent transaction will appear on the sales receipt for each purchase. In the event that the accumulated points or the total points associated with a recent transaction do not appear on the receipt because of technical difficulties, they will be updated on the receipt associated with the next transaction.
  5. The total number of points that appears on the sales receipt will be considered accurate, unless the member provides Mondou with evidence to the contrary.
  6. In the event of a product refund, Mondou will subtract the member points issued at the time of the initial purchase. Product refunds are governed by Mondou’s Return Policy and Terms of Sales.
  7. No points will be awarded for the purchase of the following products and services:
  • Delivery fees for online orders
  • Gift cards and products purchased with prepaid cards
  • Sponsorships and donations
  • Tags engraved in store
  • Special orders

Mondou will, however, award points to members when they pay for purchases using gift cards.

  1. Mondou reserves the right to withdraw points from the cards of members who:
  • Abuse privileges (e.g., obtain points fraudulently, buy for the purpose of resale or commercial use or, in the case of promotional offers, purchase a quantity that exceeds normal household use)
  • Earn points by mistake
  • Refuse to follow the specified terms and conditions
  • Make a false declaration (e.g., falsify personal information)
  1. Points have no cash value. They have no value outside the Cuddle Clubs.
  2. Points belong to registered members only. They cannot be transferred, sold, assigned, granted, exchanged, bequeathed or offered as a gift other than under the present terms and conditions.

Using Cuddle Clubs points

  1. Points are considered a means of payment just like cash at all Mondou stores. They cannot, however, be exchanged for cash.
  2. The discount value is $1 for every 50 points accumulated.
  3. Points must be used by members only, as follows:
  • In store: members show the cashier their electronic or physical card at the time of payment.
  • Online: members access their account on Mondou’s website at the time of payment.
  1. Points can be used only if the number of points accumulated reaches the desired discount value prior to the current transaction.
  2. The number of points needed to reach the desired discount value will be subtracted from a member’s points balance.
  3. Unused points and points earned during the current transaction will remain in the member account and can be used during a subsequent transaction.
  4. Mondou may announce or plan additional exclusive promotional or personalized offers for Cuddle Club or Big Cuddle Club members during which members can use their points to purchase items, convert their accumulated points into donations during fundraising periods and for organizations identified by Mondou, take advantage of various benefits or receive additional discounts. Promotional offers may vary from store to store.
  5. Mondou reserves the right to set limits with regard to the use of points by members who:
  • Abuse privileges (e.g., obtain points fraudulently, buy for purposes of resale or commercial use or purchase a quantity that exceeds normal household use in the event of promotional offers)
  • Earn points by mistake
  • Refuse to follow the specified terms and conditions
  • Make a false declaration (e.g., falsify personal information)

CUDDLE CLUB AND BIG CUDDLE CLUB AMENDMENTS, TERMINATIONS AND SUSPENSIONS

  1. Mondou may unilaterally change the following aspects of the Cuddle Clubs:
  • Eligibility criteria
  • The way in which points are earned, used and calculated (in terms of both their awarding and use)
  1. Members will be notified in writing at least 30 days before any amendments to the terms and conditions take effect:
  • Via Mondou’s website
  • Through a notice sent by e-mail or regular mail
  • At Mondou stores

The notification will specify the new or amended provision, accompanied by the previous formulation, and the date on which the said amendment takes effect. Members can refuse the amendment and terminate their participation in the Cuddle Clubs, without cost, penalty or termination fee, by sending Mondou a notice to that effect no later than 30 days following the effective date of the amendment. The fact that a member continues to participate in the Cuddle Clubs after receiving such notice will be deemed an acceptance of the amendment by the member.

  1. Mondou may terminate a member’s participation or cancel the Cuddle Clubs altogether at any time at its discretion. Members will be notified at least 60 days in advance:
  • Via Mondou’s website
  • Through a notice sent by e-mail or regular mail
  • At Mondou stores
  1. Mondou may immediately and without notice terminate the participation of a member who is in default of Mondou’s notice, in accordance with these terms and conditions.
  2. Mondou may temporarily and without notice suspend the Cuddle Clubs for any cause beyond its control, such as a technical failure or computer virus.
  3. To terminate participation in the Cuddle Clubs, a member must submit a request by e-mail to mondoucalin@mondou.com or call Mondou Customer Service at 1-855-411-5300, specifying the personal information associated with the account for identification purposes. The member’s account will be closed within 30 days of receipt of this e-mail request. The member will stop receiving messages related to the Cuddle Clubs. The termination of the membership to the Cuddle Clubs will not, however, affect the member’s subscription to Mondou’s newsletter.
  4. Following the termination of the membership for whatever reason, the card and the member number associated with the card will be cancelled, and the points balance will be reset to zero.
  5. In accordance with the conditions set out in Section 187.8 of the Consumer Protection Act (CPA), as well as the regulations under the CPA, Cuddle Club points can expire by a certain date if the account has been inactive for over a year.

To that end:

  1. Mondou will issue a written notice specifying the deactivation date.
  2. The inactivity notice will be issued 30 to 60 days before the points are to expire.

CONFIDENTIALITY

  1. Mondou ensures the confidentiality and security of members’ personal information, in accordance with Mondou’s Privacy Policy outlined at www.mondou.com/en-ca/privacy-policy.

COMMUNICATION BY E-MAIL AND REGULAR MAIL

  1. By registering for the Cuddle Clubs, members agree to receive Mondou’s newsletter regarding their participation in the Cuddle Clubs by e‑mail or regular mail.

GENERAL TERMS AND CONDITIONS

  1. All Mondou’s decisions regarding the Cuddle Clubs are final and shall be binding on all members, without any recourse.
  2. These terms and conditions are governed by the laws of the province of Quebec and the federal laws of Canada applicable therein.
  3. In case of discrepancies between the English and French versions of the terms and conditions, the French version shall prevail.
